Nationwide Denies Bicycle Accident Claim
My client was hit by a car while riding her bicycle in Maryland.
Nationwide denied my client’s claim because their insured said the Maryland accident was my client’s fault.
When I met my client at her home to do her intake, she advised that there was a witness. I ordered the Maryland police report and the witness’ address, name and telephone number were included.
My office tried contacting the witness, but had no luck.
We then hired a private investigator to find the witness. Our investigator found witness, took her back to scene and got a written statement – the accident was clearly NOT my client’s fault.
I provided the favorable witness statement to Nationwide, along with my client’s medical bills and records.
Nationwide’s response: We sent the witness a letter to verify her story, but haven’t been able to reach her, so we’re still denying the claim. You should just file a lawsuit.
I pointed out that we had to take some extra steps to find the witness and that just sending a letter wasn’t enough. Again, I was told I should just file suit.
