Pennsylvanian Carroll County DUI

How does a Pennsylvanian Carroll County DUI proceed in court?

This new DWI client is from Pennsylvania and has a Pennsylvania driver’s license.  This person was visiting friends in Baltimore and went out the night before to a bar.

On the way home, this new DWI client was pulled over by the Maryland State Police for speeding.  The police officer smelled the odor of alcohol and instigated a DUI investigation.  The new DWI client failed the field sobriety tests and had a 0.10 BAC.

After a Maryland DUI arrest, the police confiscate a person’s Maryland driver’s license and issue a 45 day temporary license.  Depending on the results of the breathalyzer, a person’s privilege to drive in Maryland will be suspended for a period of time according to the MVA DUI penalties.  Here, the state trooper did not confiscated this new DWI client’s Pennsylvania license because the police don’t have the authority to take an out-of-state license in this situation.

Typically, the police officer will still issue a temporary Maryland license after arresting an out-of-state driver for drunk driving.  A 0.10 BAC will result in a 45 day suspension of person’s driving privilege in Maryland per the MVA DUI penalties.  In this DUI arrest, the state trooper didn’t give this new DWI client a temporary Maryland license.  Therefore, this client faces no immediate action by the MVA on his privilege to drive in Maryland.

Every Pennsylvanian Carroll County DUI case requires discussing and preparing DUI defenses.  Maryland DUI penalties generally include jail time, fines, and probation.  However, should this client be found guilty, or plead guilty, this case will likely result in a probation before judgment and unsupervised probation.  Maryland judges do not typically place out-of-state residents on supervised probation.

It’s important to remember two things if you are charged with a Maryland DUI and are from out-of-state.  First, your privilege to drive in Maryland may be suspended.  Second, depending on the facts of your case, it is likely you are facing unsupervised probation for a first offense DUI in Maryland.
