A polite cooperative DUI arrest in Maryland is important.

I handled a Maryland DUI case in Worcester County, Maryland.  The client was arrested for driving under influence while on the way home from Ocean City.  This client was not polite cooperative during the Maryland DUI arrest.

It’s never a good sign when I appear for a DUI case and the prosecutor says, “Oh, you’re the lucky attorney that represents [insert client’s name.]?  Or, the police officer says, “Your represent [insert client’s name]?  I will never forget this case!”

Maryland DUI PBJ Unsupervised Probation

The prosecutor was willing to offer my client a plea to the DWI, but he would remain silent as to sentencing.  Meaning, he was not recommending a probation before judgment (PBJ).

As a Maryland DUI Attorney, I knew the first thing my client needed to do was apologize to the arresting police officer.  So, I asked the police officer to follow me, and had my client apologize.

Right before my client entered into his guilty plea, the prosecutor approached me and advised that he would offer a plea to the DUI in exchange for toning down the recitation of facts.  Meaning, he would not read into the record my client’s inappropriate and offensive behavior.

I advised my client to accept this amended offer.

After the court heard the facts, it was my turn to tell the court about my client.  I knew the court was going to ask the police officer if my client was polite and cooperative, so I decided to bring up my client’s behavior rather than let the police officer offer the information first.

I explained to the court that my client was not cooperative, but that my client had apologized to the police officer before court, and wanted to apologize again on the record.  My client offered an apologize, and the court felt that it was sincere.

The court then granted my client a probation before judgment and unsupervised probation.

After court, the court’s addiction counselor told my client that he was extremely lucky because if the court finds outs that someone is rude to the police then they go to jail!
