Video of a footage of a Maryland DWI arrest goes one of two ways.  Either, the client appears very intoxicated, or the police officer’s report exaggerates what appears on video.

In this case, the video footage showed a major discrepancy in the police officer’s report.  The time sequence of the video and the police officer’s report was off by one hour!  Meaning, the police officer said our client was arrested one hour later, than the video actually showed.

This is important because the breathalyzer test must be taken within two hours of your arrest.  Here, the video made it very clear that our client was not given the breathalyzer test within two hours of his arrest.  However, the police officer’s report indicated that the timeline was fine.

Our office immediately brought this to the attention of our client.

Ultimately, our client felt that it was in their best interest to accept the Baltimore City State’s Attorney’s Office DUI plea agreement.  The client received a probation before judgment, one year of supervised probation and a $0.00 fine.

Additionally, over the objection of the Assistant State’s Attorney, the court agreed to reconsider unsupervised probation.
