Noah’s Law Signed by Maryland Governor Larry Hogan

On Thursday, a DUI bill known as Noah’s Law was signed by Maryland Governor Larry Hogan. With Noah’s Law signed, new changes are coming to Maryland DUI law.

The bill, named in memory of Montgomery County Police Officer Noah Leotta who was killed by a suspected drunk driver, passed both houses of the Maryland General Assembly in April.

Officer Leotta’s death sparked a renewed pressure to expand Maryland’s law related to the use of ignition interlocks.  The ignition interlock is a device that requires a driver to blow into a breathalyzer before their car will start.

Under Noah’s Law, anyone convicted of drunk driving in Maryland will be required to install the ignition interlock device in their vehicle.  Keep in mind, a probation before judgment is NOT a conviction.

Another important change is lowering the BAC limit to 0.08 for MVA consequences. Previously, interlock ignition devices were possible for drivers with a 0.15 BAC or refusal.

As a final note, on Wednesday, the driver charged with striking and killing Officer Leotta pled guilty in court.  Sentencing was deferred until August.
