The answer depends on your breathalyzer results.
Maryland DUI MVA Penalties
If you are arrested for drinking and driving in Maryland, then your license will be confiscated by the police officer and you will be issued a temporary license for 45 days. If you do nothing, then on the 46th day after your arrest your privilege to drive in Maryland will be suspended. The suspension period depends on the results of your breathalyzer test.
The MVA suspension for a first offense with a 0.08-0.14 BAC is a 180 day suspension, modification, or interlock. Here, you could have your suspension modified to allow you to drive for employment, educational and medical reasons. In order to obtain a suspension modification, you must request a MVA hearing within 10 days of your arrest by mailing the request form and $150.00 to the MVA. If the judge doesn’t grant you a modified license, they likely will offer you the chance to enter the interlock program for 180 days.
The MVA suspension for a first offense 0.15 BAC or greater is a 180 day suspension, or one year interlock. Here, there is no option to have your suspension modified, but you could opt into the interlock program for one year.
If you refuse the breathalyzer test, then the MVA suspension is a 270 day suspension, or one year interlock. Just like a 0.15 BAC or greater, there is no option to have your suspension modified, but you could opt into the interlock program for one year.
Bottom line: your privilege to drive in Maryland will be effected by a DUI arrest. However, you likely will not lose your license, but have the suspension modified or deferred to the interlock program.
