Maryland Burglary Penalties & Charges
Under Maryland burglary and theft laws, burglary in the 1st degree is breaking into another person’s residence with the intent of stealing their property. This charge is a felony and if convicted one may face up to 20 years in prison. Burglary in the 2nd degree is very similar to the first degree but instead of entering a residence the suspect would enter a storehouse, such as a garage or a shed. The maximum sentence for this is 20 years in prison. Burglary to the 3rd degree is considered entering a residence with the intent to commit a crime, and one may face up to 10 years in prison. Lastly, burglary to the 4th degree is usually charged with the assumption of entering a person’s property when not welcomed. This is only a misdemeanor and one may possibly face up to 3 years in prison.
