Why would I need to take an alcohol education class! I’ve never had a DUI or any alcohol-related offense?
That’s a common question my office receives from first-time drunk driving offenders in Maryland.
The answer is simple: If you don’t, then the court is going to make you.
Alcohol education after a DUI arrest in Maryland
Recently, our office was contacted by a potential client that was arrested for a first-time DUI. The client sent a submission via our website advising that they had been arrested and refused the breathalyzer test.
Our office responded within a reasonable time and advised the potential client of the appropriate steps. One of those steps was letting the potential client know they needed to have an alcohol assessment done and complete an education program.
The potential client was adamant that they didn’t need alcohol education since this was their first DWI arrest.
Our office explained that in every DUI case, the defendant should enroll in and complete an alcohol program, because if they don’t, then the court will order them to do it anyway. Also, it looks a lot better if you come to court having already either enrolled or completed the program.
For many first-time DUI offenders, our office explains that the alcohol education course isn’t recommended because you’re an alcoholic or have issues with alcohol, but more so to satisfy the court that you are taking this DUI arrest seriously. By far, the most important evidence to present at sentencing is any alcohol education or treatment programs you have completed.
