Lawsuit leads to fair settlement

Here, the at-fault party was a Pennsylvania resident.

The insurance adjuster was misapplying Pennsylvania law to a Maryland case and making an offer based on “unpaid medical.”  Since this was a case of potentially aggravated liability (leaving the scene and negligent entrustment) we urged our client to file suit, which the client authorized.

Our office filed discovery to the defendants and when it became clear that they were not going to cooperate with their own counsel, we subpoenaed them to the trial.  That got the defense counsel enlisted in trying to get the case settled since counsel didn’t want to have to show up in court without clients, or, perhaps worse yet, with clients who were present and belligerent.

Our firm filed suit for $15,000.00  and ultimately got a $12,000.00 offer, which was actually more than the client even expected.

Sometimes you just have to file a lawsuit in order to get a reasonable settlement.
